TASK4PROS, a service platform developed and managed by techlogistics servicos de tecnologia DA INFORMACAO LTDA, legal entity registered in CNPJ nº 35.677.682/0001-56, with headquarters in the city of Campinas, State of São Paulo, at Rua Conceição, nº 233 - SL. 916 - Centro, CEP 13010-050 and e-mail contact@task4pros.com, comes to present its Privacy Policy and Cookie Policy, accordance with Law No. 13,709/2018 (effective August 16, 2020) in the terms below.

In this document we wish to make you aware of how we collect and process your data on the platform, for what purpose we will use it and with whom we will share it, without any discrimination in the creation and provision of the platform service.

We will define below how we use and protect the information you provide by using the services provided on the TASK4PROS platform. The commitment is to ensure that your privacy is protected in accordance with the General Data Protection Act (LGPD), Law No. 13,709/2018 (effective August 16, 2020).

1. Privacy Policy

General definitions

Personal data: information related to identified or identifiable natural person.

Data subject: natural person to whom the personal data that are processed refer.

User: every person who accesses or uses the TASK4PROS Platform. Unless expressly stated otherwise, the terms "you", "your" or "your" refer to the User (Data Subject).

Users-Plates: the application will provide logistics management and management technology for loading and unloading shit to companies providing cargo loading and unloading services, dockworkers, self-employed, liberal or single professionals or any natural or legal persons (the "Users-Plates").

Users-Borrowers (Companies / Shippers): the application will provide logistics management and management technology for loading and unloading cargo to carriers, professional drivers liberal or autonomous, logistics operators or any other natural or legal person (the "Users-Takers").

Processing: all operations performed with personal data, such as those related to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction.

Consent: free, informed and unambiguous manifestation by which the holder agrees to the processing of his/her personal data for a specific purpose.

Cookies: Sets of user data stored on the device.

Controller (owner): natural or legal person, under public or private law, to whom decisions regarding the processing of personal data are responsible.

Operator: natural or legal person, under public or private law, who carries out the processing of personal data on behalf of the controller.

Owner: it is understood that the owner, for the purposes of this Privacy and Cookie Policy, is the TASK4PROS Platform.

Usage data: Is the information automatically collected through the website, TASK4PROS Platform or third-party website, such as: IP addresses or domain names of users' computers, URI (Uniform Resource Identifier) addresses, request time, method used to send the request to the server, file size received in response, numeric status code  server response, country of origin, user browser and operating system features, time per visit and path followed within the site, as well as special reference to pages visited, and other parameters about user operating system and IT environment.

Platform / Service: what the TASK4PROS platform provides in accordance with the Terms and Conditions of Use available through the link, both through its mobile app and through its website.

The collection and purpose of the processing of personal data

In attention to data protection laws, we inform you that the TASK4PROS platform collects some personal data from users, which are provided by the user himself or, in the case of usage data, collected automatically through Cookies and/or by the system / platform itself.

The registration data provided by You are strictly necessary for the TASK4PROS platform to provide the contracted services, identify you, contact you, comply with legal requirements, as well as for statistical purposes and improvements in the User's experience, which includes: first and last name, date of birth, telephone number, email address, CPF, full home address, photo, if you have A MEI registration and a resume submission. By using the TASK4PROS platform we may automatically collect and determine information from your approximate location, based on the GPS (Global Positioning System) of the device you are using to access TASK4PROS or even through information from your internet connection, obtained through your IP address (Internet Protocol), in order to enable the provision of services close to You, within a certain radius of the distance.

In addition, in addition, data will be collected and processed for the purposes of payment of the requested services and/or charges of pendencias, through forms made available and administered by a third party platform, when made available.

Mandatory data for completion and automatic capture will be flagged in the forms provided, noting that the non-provision of such data may prevent and/or limit access to the services offered.

The User is solely responsible for the information filled in, and must provide true, accurate, current and complete personal data, as well as keep it up to date. In addition, the User is solely responsible for any third-party data obtained, published or shared by him on the TASK4PROS platform.

Regarding the mode and place of data processing, the TASK4PROS platform undertakes to seek security measures aimed at preventing unauthorized access, disclosure, modification or unauthorized destruction of data, including the use of encryption systems in the data store, through third-party companies that store and process the platform system.

In addition, it is reported that the processing of data is done by computers / IT tools, following organizational procedures for specific purposes. In certain cases, in addition to the owner, the data may be accessed by other responsible persons involved with the platform (administration, sales, marketing, legal, Information Technology team) or third parties, if necessary (technical service providers, mail operators, hosting providers, IT companies, communication agencies, hosts), who can act as data operators. Consent

The TASK4PROS platform may process personal data related to users with prior and express consent.

The duration of the storage and processing of the data referred to herein is for an indefinite period and will be maintained for the time necessary until the fulfillment of its objective, and/or until there is revocation of the consent given by the USER or when so requested by means of judicial or extrajudicial determination, when applicable, as well as for the duration of the operations and legal records of TASK4PROS, always respecting the applicable legal standards.

Furthermore, it is important to inform You that, once terminated or defunct your account on the TASK4PROS platform, we must store your data for as long as the law requires, as well as provide it to the authorities when requested.

Users' rights

Pursuant to Article 18 of Law No. 13,709/2018 (effective August 16, 2020), the user may, upon express request and respecting the legal deadlines, exercise his rights to:

confirmation of the existence of treatment;

access to data;

correction of incomplete, inaccurate or outdated data;

anonymization, blocking or deletion of unnecessary, excessive or processed data in non-compliance with the provisions of that Law;

portability of the data to another service provider or product, by express request, in accordance with the regulations of the national authority, in compliance with trade and industrial secrets;

deletion of personal data processed with the consent of the holder, except in the cases provided for in Art. 16 of that Law;

information of public and private entities with which the controller made shared use of data;

information on the possibility of not providing consent and on the consequences of the negative;

withdrawal of consent, pursuant to Paragraph 5 of Article 8 of that Law.

From the ads

The TASK4PROS platform collects and uses information contained in advertisements. This information may include your INTERNET Protocol (IP) address, your ISP (Internet Service Provider), the browser you used when visiting our website, the time of your visit and which pages you visited within our website and/or application.

From providing data to third parties.

The TASK4PROS Platform may share your data with third parties to provide the service offered, such as: storage, identification, payment and validation, feasibility of offers and services of the Platform (including, but not limited to: Amazon, Facebook, Google and LinkedIn); in the prevention and fight against crimes, technical or security problems. In addition, your personal data may be shared to comply with legal obligation and requirement, court decision, arbitration, conduct adjustment and administrative term.

The transfer of personal data and geolocation between Platform Users

With the objective of the effective provision of the services offered by the platform, and aiming to seek transparency and security between the parties, some personal and location data will be made available among users of the TASK4PROS system (Borrowers / Plates), as informed during the use of the application, and in the terms set out below.

User Data - Plate: Before acceptance of the service (pre-accepted) will be made available, for visualization in the application: the name, the evaluation note (when available) and the approximate distance between the parties (based on the data registered in the system). After accepting the service (post accepted), the application will provide the following data: first and last name, phone number, photo, address registered in the system and current location (based on GPS / mobile network), if the User has consented to the use of the geolocation system in real time.

User Photo - Plate: will only be made available after the acceptance of the service offered by the User - Taker. There is the possibility of allowing the availability of photo at the time of pre-acceptance, if such functionality is selected by the User during the use of the application. The photo is available for the purposes of identifying the parties and for security reasons.
Current location / User address - Plate: location data is essential for the provision of services, since job offers will be filtered and connected according to the locality of the parties. The address provided by the User - Plate will be the basis for the offer of opportunities. Real-time location usage will only take effect when the application is open and the User activates, and maintains, the real-time positioning system.
User Data – Borrower: Before acceptance of the service (pre-accepted) will be made available, for visualization in the application: the name of the driver, the evaluation note (when available) and the approximate distance between the parties (based on the data registered in the system and / or location in real time). After accepting the service (post accepted), the application will provide the following data: driver's first and last name, phone number, photo, address registered in the system and/or current location (based on GPS / mobile network) if the User has consented to the use of the geolocation system in real time.

Links to third-party websites and newsletters (mailing list)

The TASK4PROS Platform has links to other sites, which may contain useful information / tools for our visitors. Our Privacy and Cookie Policy is not applied to third-party websites, so if you visit another website from our platform, you should read the privacy policy of the same, since we cannot be held responsible for the third party Privacy Policy.

By registering interest in the mailing list or newsletter, the user's email address becomes part of the list that receives email messages with commercial or promotional information relating to this platform. Your email can also be added to this list after signing up on the site or after making a request, appointment, purchase, or contact. If you wish to stop receiving newsletters, please proceed with the instructions contained in the email sent (unregister), or contact our team.

If there is a third-party content feedback service, it can collect web traffic data for pages where the feedback service is installed (even when the user does not use the content feedback service).

Displaying content from external platforms

Service that allows viewing of content hosted on external platforms and interaction by the pages of the site, collecting web traffic data even when the user does not use it, with the Google Maps Widget, Instagram Widget, Spotify Widget, Vimeo Video and YouTube Video Widget.

Remarketing and behavioral segmentation

Usage-based advertising by tracking usage data and cookies, information that is transferred to partners who manage remarketing and behavioral targeting. Deactivation can also be done directly on these sites. They are Facebook Custom Audience and Facebook Remarketing.

Traffic optimization and distribution

How to consent to or withdraw permission to install cookies

TERMS AND CONDITIONS OF USE - "My Plate"

Initially, we inform you that the mobile application called "My Plate" is a software developed and administered by TECHLOGISTICS, and our legal and contact details are: TECHLOGISTICS INFORMATION TECHNOLOGY SERVICES LTDA., based in the city of Campinas, State of São Paulo, at Rua Conceição, nº 233 - SL. 916 - Centro, CEP 13010-050, registered in CNPJ/MF under no. 35.677.682/0001-56 e-mail e-mail contact@task4pros.com.

This document aims to explain the rules and conditions that will guide the use of the services offered by TECHLOGISTICS, through the mobile application called "My Plate", as described below.

The use of the TASK4PROS platform (composed of the Website and/or Mobile Application) subject the user to compliance and respect for the conditions set out below. Please be clarified that to use the TASK4PROS platform, you must agree to these Terms and Conditions of Use and the Privacy Policy. If you disagree with the above in these documents, you will be prevented from accessing the platform.

It is important to inform you that the service provided by the TASK4PROS Platform is or may be subject to Specific Licensing, Decings, Terms of Use, Contracts and Regulations. In the event of a conflict between such instruments and this document, the specific conditions shall prevail.

The Privacy Policy and Cookie Policy are part of these Terms and Conditions of Use and may not, in any case, be dissociated from this document.

1. Preliminary definitions

My Plate: Web and mobile application (Android and iOS) developed and administered by TECHLOGISTICS for management and management of cargo loading and unloading, locating and connecting cargo transport companies with autonomous service providers ("Plates").

Application, or Platform (digital): refers to both the Website and the Mobile Application, developed and managed by TECHLOGISTICS, unless expressly provided in a different way.

User: every natural or legal person who accesses or uses the My Chapa Platform. Unless expressly stated otherwise, the terms "you", "your" or "your" refer to the User.

Task: all loading / unloading service registered on the platform by the User - Taker in order to seek a service provision by the User - Plate.

Service: The application will provide information on demand for cargo boarding and unloading services by Users-Borrowers, either at the origin or destination, and reoperating with management system with geolocation, making available to Users-Plates the best demands for tasks / services, according to their predefined availability, in order to ensure users the best management system and management of cargo loading and unloading services. Through this application, the User-Taker can register demand for tasks / services of loading and unloading of cargo, and may also release real-time information about the progress or forecast of cargo (loading) or unloading (disembarkation or delivery), including extra events that prevented and / or changed the date and / or destination provided. In addition, the platform has a real-time tracking system (via GPS and mobile network), which aims to allow the monitoring of the logistics process, indicating the current position of freight. The My-Chapa application does not intermedia contracting, does not provide cargo loading and unloading services, nor cargo transportation, but only provides modern management and management system so that Users can make their services available to each other.

2. Consent.

Access to the TASK4PROS Platform (both through the Website and the Mobile Application), as well as its effective use, implies that You knowingly accept and agree to these Terms of Use and our Privacy Policy. If you disagree with the provisions here, we ask that the user not use the platform.

Acceptance and agreement will be ratified by selecting the checkbox corresponding to the option "I accept the Terms", an opportunity in which You express your free and express consent that, duly informed, you agree to the content of this Terms of Use and other related documents. By accepting these Terms You also claim to be the legitimate holder of the personal data entered in the TASK4PROS platform, which is solely responsible for the veracity and authenticity of all the data and information provided to our Platform and for the use of this, made through your registration account.

By accepting these terms, the user acknowledges that he is solely and exclusively responsible for the use of the Platform, being responsible for the complete reading and acceptance of the rules of use, exempting TASK4PROS and its partners from any liability for damages and losses arising from the misuse of this Platform. Furthermore, you agree that all communication between TASK4PROS and the Users, as well as between them, will be carried out through the tools made available on the platform and/or website.

Furthermore, by agreeing to the terms, You expressly authorize TASK4PROS to share your platform usage information and registration data among the Users of the platform, in order to provide and provide the best and most efficient experience and service. It is emphasized that the information shared will be only those necessary for compliance with the act, or by legal obligation.

3. From the Register

Prior registration is necessary for You to enjoy the services provided, as well as will be the means of contact with the Platform. Therefore, the User must provide true, accurate, current and complete personal data, as well as keep this information up-to-date on the Platform.

Additional data should be provided so that all services are effectively made available, such as bank details (where applicable) and access to the geolocation system (GPS and mobile network).

The personal data provided by You are those strictly necessary for the TASK4PROS Platform to identify you, contact you, comply with legal requirements, effect agreed charges, as well as to provide better experiences, offer specific products for your taste and profile and ensure your security, in accordance with our Privacy Policy.

In addition, all data shared by You will be held securely by TASK4PROS, in accordance with the terms set out in the Privacy Policy.

3.1 The Request for Cancellation of Registration.

We want to maintain a long relationship with You, however, if you wish to cancel your registration on the TASK4PROS Platform, you can do so at any time by simply logging into the platform with your username and password, accessing the "My Registration" section in the main menu of the TASK4PROS platform and then choosing the option "Remove Registration" just below your data. If you have difficulties, send us a message to the email contact@task4pros.com.

You should be aware that the cancellation of registration will import in loss of access to your data of use of the Platform, as well as will not exempt you from any pending or open charges.

Furthermore, it is important to inform You that, once you have completed or extinguished your account on the TASK4PROS Platform, we must store your data for as long as the law requires, as well as provide it to the authorities when requested.

4. Platform Usage Rules

TASK4PROS informs that, aiming at greater dynamics and quality in the provision of its services, the details about services offered and form of relationship / interaction between users will be made available and kept updated on the platform. It is recalled that such information may undergo recurring updates, aiming at better communication and experience for the parties. Please always access the platform for up-to-date information.

You declare science and agree that the use of the login and password are very personal and non-transferable, being allowed only one account per User; that You will respect all copyright, moral, material and related, as well as those owned, patented and marketing the content you have access to.

You declare science and agree, too, that it is prohibited: a) the creation of a user account per person who has been inbilitated by the platform, regardless of the reason; (b) the insertion in the My Plate Platform of any type of content that is illegal or that is not directly related to the objectives of the platform; (c) the use of the trademark, name, or any type of reference or data of the My Chapa platform for illicit purposes or that may, in any way, denigrate the company's image; (d) share your login and access password with third parties, even if authorized.

The Platform reserves the right to refuse any registration request and to cancel a previously accepted registration, in its sole discretion and without notice, in the event of non-compliance with the rules of this document and the Privacy Policy, as well as in cases that contrarite Brazilian legislation and/or contractual provisions. In addition, if this occurs, there will be no compensation or reparation for the cancellation of any registrations or impossibility of registration. Other situations will be deliberated and communicated by the e-mail registered by the user and/or notices on the Platform.

4.1. Evaluation and feedback services

If Users wish to make comments and/or evaluations regarding our Platform and/or services offered / provided by Users, we kindly ask you to use the tools available on the platform for such act, and your rules of use should be paid to at the time of use.

Regarding the evaluations of the services provided, it should be noted that users should necessarily opt for one of the evaluation notes made available after the completion of the service. This system aims to analyze and qualify the service provided by the evaluated user.

It should be emphasized that the average of the grades obtained, for each User, will be available to all others, aiming to be a mode of analysis and selection of the professional for the other Users at the time of the pre-acceptance (verification stage and choice of services / professionals available for hiring).

It should also be noted that, according to the instructions set out on the platform, Users who have a low level of evaluation and utilization (such as repeated delays and unjustified cancellations), will be suspended and/or excluded from the platform, at the discretion of the platform's parent company, and will no longer be able to take advantage of the services offered.

Also, optionally, Users will be able to fill out / respond forms containing more information about the services and professionals after the completion of the provision of the service. This information will only be available between the parties involved and to the platform's collaborators, as set out in the system.

Users, employees of TASK4PROS, or any other person who sees any offensive, illegal and/or unrelated content from the services provided by TASK4PROS may make a request for verification and/or removal of content via e-mail: contact@task4pros.com.

Finally, it should be emphasized that, regardless of the verification and/or removal of inappropriate, offensive or illegal content by TASK4PROS, the User or host responsible for the act may respond administratively and/or judicially, both in the civil and criminal spheres, in accordance with applicable laws.

5. The General Conditions of Use

The use of the services provided, including their conditions and restrictions, will always be available on the platform in a clear and up-to-date manner. Thus, the provisions put here aim to formalize the main rules, and should always be read and analyzed together with the above on the platform, at the time of consultation and use. In addition, it is advisable to periodically consult the conditions, since updates and improvements to the system / platform may occur on a recurring basis, always aiming at a better provision of the services offered.

5.1 User - Plate

After proper registration and agreement with the conditions of use of the platform (Terms of Use and Privacy Policy / Cookies), the User will have access to the list of tasks available in his region, according to the information recorded by users - Borrowers, which is updated in real time.

The region considered by the system is an area that covers a predefined distance around the address provided by the User - Plate at the time of registration in the system. This area varies by region/city. Please refer to the platform about your region's rules for up-to-date information.

The service consists of four steps: Pre-accepted, Task Selection, Post-Acceptance and Completion / Receipt of Values.

Pre-accepted: the User – Plate will have access, through the platform, to a list containing the available tasks, in the terms above, which will contain basic information of location of the service, value, date and time of completion deadline, evaluation note (when available) and name of the company / driver responsible.

Task selection: after checking the list of available tasks the User - Plate can select one, requesting its hiring, at which time the User - Responsible Taker will receive a notification, containing information of approximate distance, user name - Plate and grade note (when available).

Post-acceptance: by exclusive decision of the User - Borrower, the User - Plate can be accepted or refused for the task. In addition, the User - Borrower may, based on the information registered in the system, request and accept the provision of services of more than one User - Plate per task.

At this stage, additional data, including personal data, will be passed on between the parties (please check our Privacy Policy for more information).

Completion / receipt of values: after the completion of the task, the User - Plate must make such confirmation on the platform, as well as evaluate the User - Taker in the terms exposed in the system. At this time the User - Borrower must make the payment of the amounts registered in the task directly to the User - Plate, or authorize the electronic payment via platform (when available) for the services provided.

5.2 User - Borrower

After proper registration and agreement with the conditions of use of the platform (Terms of Use and Privacy Policy / Cookies), the User will have access to the list of Users - Plates available in his region, according to the information recorded by users - Plates, which is updated in real time.

The service consists of five stages: Task Registration, Pre-accepted, Post-accepted Plate Selection and Completion and payment of amounts.

Task registration: the User - Borrower must register the task offered, according to the form provided. Each task shall contain all information flagged as mandatory on the form, and comply with the rules of this document and the legal provisions.

Pre-accepted: the User - Borrower will have access, through the platform, to a list containing the Users - Plates available, in the terms above, which will contain basic location information, evaluation note (when available), User name - Plate and photo (when available).

Plate selection: after checking the list of Users - Plates available, the User - Taker can select one (or more, according to the information registered in the task), requesting the provision of the service, at which time the User - Responsible Plate will receive a notification, containing information of approximate distance, user name - Borrower and notification of boiling (when available).

Post-accepted: by exclusive resolution of the User - Plate, the task may or may not be accepted. In addition, the User - Borrower may, based on the information registered in the system, request and accept the provision of services of more than one User - Plate per task.

At this stage, additional data, including personal data, will be passed on between the parties (please check our Privacy Policy for more information).

Conclusion and payment of amounts: after the completion of the task, the User - Borrower must make such confirmation on the platform, as well as evaluate the User - Plate in the terms exposed in the system. At this time the User - Borrower must make the payment of the amounts registered in the task directly to the User - Plate, or authorize the electronic payment via platform (when available) for the services provided.

Assignment of Receivables: Task4Pros may assign to third parties the amounts arising from the provision of services, through assignment of the document representing the credit, but remains solely liable to the User - Borrower for the services to be provided.

5.3 Cancellations /changes

Changes and cancellations of tasks, made by any of the parties involved, can only be effected before the post-acceptance step. In the event of any change in the contract between the parties, and they do not agree, this will negatively impact the assessment note of the guilty party. Furthermore, in case of reiteration, the guilty party may be suspended and/or excluded from the platform, according to the resolution of the team responsible in the platform management company.

The above penalty does not pre-issue the payment of the fees / amounts due to this platform, under the contractual terms. Furthermore, the suspension and/or exclusion also does not prevent any legal or extrajudicial action that one of the parties, and/or the company managing the platform, will propose in the face of the party causing the damage suffered.

5.4 Payment for the use of the platform (User - Borrower)

Users – Borrowers agree that they will be charged a commission amount on the amounts of the tasks registered and accepted. Such amount must be paid by bank slip to be issued monthly, which will add up the amounts of all tasks accepted during the month prior to the issue. For more details of the process, please refer to the financial panel, available on the platform.

Alternatively, and when available, payment of the services performed may be made, and the respective commission rates, through an electronic payment system. In this mode of payment the full amount of the contracted service and the commission fee will be debited from the credit card / bank account of the User - Borrower and effected the division of amounts due to the User - Plate (by credit in bank account or prepaid card) and the platform My Plate, from outside automated.

On payments not made until the due date, fines and interest will be imposed, as well as the suspension and/or exclusion of the User - Borrower.

6. The Responsibility of the Parties

By accepting these terms, the User acknowledges that he/she is solely and exclusively responsible for the use of the TASK4PROS Platform, as well as for the services contracted / performed, being responsible for the complete reading and acceptance of the rules of participation, as well as for the payment and its criteria of use, exempting TASK4PROS and its partners from any liability for damages and losses arising from the misuse of the TASK4PROS Platform.

It is emphasized that the platform aims to provide information and contact between users, in order to present opportunities for tasks (Users - Borrowers) and service providers (Users - Plate) according to the registration data filled out and other information made available by the parties. Such information is provided by users, thus being their full responsibility for accuracy and updating.

Considering that the services made available on the platform are offered and executed by third parties (Users - Borrowers and Users - Chapa) not linked to this company, TASK4PROS is not responsible for the service provided, delays, cancellations or any kind of harmful act and/or omission that occurred among users users of the platform.

Users declare that they have all professional and legal records that allow them to offer and fulfill the tasks registered and carried out through this platform. They also declare that cargo, products, goods and the like are not illegal, under applicable laws, nor have they been obtained unlawfully.

It should be highlighted that the current rules apply, not excluding any applicable legislation. Furthermore, it should be noted that the provisions herein does not restrict or prevent any out-of-court or judicial measures by any party that may be harmed during the use of the application.
